Sayyid al-Sistani considers a person who owes money to a bank/other entity as not capable (mustatee’) of Hajj. How is this solved by the process called a “giveaway” or badhl, and does it work?
A person can use a process called a “giveaway” or badhl if the obligatory Hajj does not interfere with paying the debt on time. This can be achieved through a conditional agreement with the leader of the Hajj group by saying “I will gift you this amount of money as a “giveaway” on the condition that you provide me all that is needed to go to Hajj” and the leader accepts the “giveaway” [and the condition]. One can also gift the money to his wife and after she accepts it she can pay it to the Hajj group and cover her husband’s costs to perform Hajj if she wills.
