I and my three-year-old daughter were abandoned for three years by my husband, he has not supported financially during this period and he has left me in limbo. What is my legal Islamic right and can he take my daughter, as he said that he would not give me a divorce unless I give him my daughter?
You would be within your rights to ask for a divorce from the jurist (talaq hakem) and he is within his rights to regain custody of his daughter.
