What is your question?

I would be happy if you can guide me for the following questions:
1) Referring to the rules given in sistani.org, what is meant by "Profit or gain from earnings" in rule 1760? Does this include the earnings from monthly salary?
2) If it includes monthly salary, how do we calculate it?
3) How do we fix the date for giving khums?
4) Can we fix the date from Gregorian calendar?
5) About calculation of khums: Let's say I had $500 in the first year, I paid $100 as khums, the mukhammas amount is $400. Let's say next year, I had $200 on the date of khums. So, I didn't have to pay any khums. Please correct me if I am wrong. The third year, I have let's say $500 again.
i. How do I calculate the khums now? Do I have to give 500/5=$100 as khums or (500-400)/5=$20 as khums?
ii. What is the mukhammas amount now and what should I consider for the next year?

Answer

1. Profit here means earnings that are above your annual expenditures and have remained unused for a year making it subject to khums.
2. Refer to 1.
3 & 4. Select any date from the Hijri or Gregorian calendar.
5. Before the series of questions are answered please clarify if the money you have at the end of the year is from the original mukhammas 500 or in addition to it. Just remember that any profits over which a year has past is subjected to khums. Once the fifth is removed from that money, it is not subject to khums again. Any new profit made over which a year passes is subjected to khums, not the khumsed money from the previous years profit.

What is your question?

I actually wanted to ask about the calculation of khums in the third year.
Could you please fill the table given below?

===========================================================
Yr | Total amount | Mukhammas | khums | Total

===========================================================
1 | $1000 | $0 | $200 | $800
-----------------------------------------------------------
2 | $600 | $800 | $--- | $---
-----------------------------------------------------------
3 | $500 | $--- | $--- | $---
-----------------------------------------------------------
4 | $2000 | $--- | $--- | $---
-----------------------------------------------------------

Answer

Your chart sheet:
Year 1:
This is fine.
Year 2:
If the $600 remaining that year is from the $800 of year 1 then there is no khums due on this amount in year 2. However, if it is new profit that has remained unused for one year then it is subject to khums.
Year 3:
If the $500 remaining in the account is from the $800 of year 1 then there is no khums due on this amount for year 3. However, if it is new profit that has remained unused for one year then it is subject to khums.
Year 4:
If the $2000 is actually the $500 from last year (which was remaining from the $800 from year 1) plus a new $1500 then you must only pay khums on the $1500.

What is your question?

I would like to get more clarification on the rules of Zakat that relate to Gold with the following questions:
1- Is it obligatory to pay Zakat on Gold (that reach taxable limit) that is received as part of the Mahr (marriage dowry)?
2- Is it obligatory to pay Zakat on Gold that was received as marriage gifts from parents and parents-in-law and siblings?

Answer

Zakat is only obligatory on gold coins, not gold that is worn as adornment. Khums, however, is due the gold if it is not worn for a year.

What is your question?

Do you mean that Khums is due on NEW gold jewelry that was not worn for a year? How about gold ounce (1 thin rectangular brick), which cannot be worn as jewelery: Is Khums due on it? If so, and we still have debts, do we have to pay khums?

Answer

There is no zakat on gold that is not coinage or stamped money, that means there is no zakat on jewelry and bricks of gold. With respect to khums it is required on gold whether jewelry or bricks that are unused for a year.

What is your question?

1) Can I borrow money from my home equity line of credit to go for my wajib hajj?
2) Do I have to pay khums on the money I am borrowing for the hajj?
3) Can we give fidya money to an organization helping shohuda's families in Pakistan. Does it has to be used in food only.

Answer

1. Yes you can, but it will not count as a wajib (obligatory) hajj but a mustahab (recommended) haj. Note, it is not your obligation to take out from a line of credit or a loan to go to haj. If you are financially unable to go, or are financially able but you would lose your job when you return, or you would not have enough money to support yourself or your family by going to hajj then it is not obligatory upon you.
2. If a year passes over the money and it is unused then you do have to pay khums on it. If not, then no if the money is being used for haj expenses.
3. Yes you may, as long as it is used for food only.

What is your question?

I am a married woman that also works, I would like to contribute my earnings to support my parents. My husband tells me that I must support him and our family, but I want to support my parents. What is the ruling on this issue?

Answer

Islamically, you are not required to support his family. His parents and the children are his responsibility. If you want to help out in supporting him then that is out of the kindness of your heart. He is required to support you, not vice versa.
As for your own income, that is strictly yours to do with as you please. You can support your parents if you please, though it is the obligation of the eldest son. However, Islamically nothing prevents you from supporting them.
